Specific requirements are to be confirmed when an order is placed.
On receipt of an order 6gl will issue an invoice for 20% of the quoted price. NO work
will commence until this invoice is paid and once work, refered to in the 'Objectives and Requirements', has commenced this
will be non refundable.
After completion of the site and the User Acceptance Test 6gl will raise the final invoice for the work done.
Flexible contracts can be arranged spreading costs through monthly or quarterly payments. Otherwise normal Payment terms are 30 days or less.
Objectives And Requirements
A Web site brief is to be provided and should include:
Site Concept
Style, Look and Feel - Description of how the client wishes to 'see' the site
Purposes of Site - A description of the function of the site
Quality Perceptions - Description of the client's expectations
Specific Requirements
Time Scale - When is the site required by.
Pages - What number of pages is expected to constitute the site?
Colour - When using colour in a computing environment particular shades/tones will vary from screen to screen depending on many variables. How important is the precise colour to the client?
User Interaction - If the client requires more than a standard marketing site describe exactly what is wanted.
Browser - Is there a specific browser to be utilised. Note: the higher the browser version the more that can be achieved with the site pages. However, the target audience should be considered when doing this as many public users have older browser versions.
Data Availability
Text - Information to be included in the site. Whether this is available in electronic media or the client requires 6gl to create any or all of this data.
Images - Images to be included in the site. Whether the images are available in electronic media or the client requires 6gl to create any or all of these images.
Notes - Any other comments or information that will enable 6gl to produce the right product at the right price for the Client.
Other Terms
6gl, the Internet division of T&C Management Limited (hereinafter referred to as "6gl") agrees to provide services as detailed in the Designer's quotation, budget price or Confirmation of Appointment to the individual, organisation or public body referred to therein (hereinafter referred to as "the Client").
Unless specifically varied in 6gl's Confirmation of Appointment or otherwise in writing by 6gl, the following payment terms shall apply: all fees quoted are exclusive of VAT and to the extent that VAT is chargeable in respect of any goods, work or services supplied by 6gl, VAT at the rate in force at the time of supply should be added to payments otherwise due. Pro-forma accounts will be rendered calendar monthly and/or on completion of the services provided and will be due for payment strictly within 14 days of submission. Upon receipt of such payment, 6gl will furnish a tax invoice in respect thereof, the tax point being the date of such payment.
In certain circumstances at its discretion, 6gl may require some monies to be paid prior to commencement of work on account of fees likely to be incurred.
All fees quoted are subject to review and adjustment by 6gl.
In the event that full payment is made later than required by Condition 2. hereof or if only partial payment is made, 6gl may at its absolute discretion charge for administration costs and interest on any monies owed at either the rate of 2% interest per month or at the annual rate of 7% above the base rate published from time to time by Barclays Bank plc, whichever is the greater rate, calculated weekly and compounded monthly. Failure to apply such charges does not constitute a waiver of the option so to charge.
6gl reserves unto itself the right to withdraw its services at its entire discretion, particularly in the event of any failure to pay its pro-forma accounts and invoices or, where the Client makes its own arrangements for provision of storage space with an Internet Service Provider, if the Client does not make available or continue to make available server storage space to 6gl. Upon such withdrawal of its services, 6gl shall be under no liability whatsoever to the Client for any costs, losses and damages, howsoever arising, that the Client may incur or may have incurred.
It is hereby agreed between 6gl and the Client that where 6gl withdraws its services pursuant to Condition 6. hereof, 6gl may remove any material stored upon any computer or server and shall retain, and shall not be under any obligation to return or provide access to, any and all documents, papers, etc. belonging to the Client until payment is made in full of all 6gl's pro-forma accounts and invoices.
Copyright in all documents, papers, etc. prepared or caused to be prepared by 6gl is expressly reserved by 6gl.
The Client shall indemnify and save harmless 6gl against any claims that may arise out of the content or nature of the material stored upon any computer or server or which may be prohibited or protected by laws of any country or state relating to copyright, confidentiality or intellectual property.
These Terms are governed by and subject to English Law.
NB
Complex Site Requirements - Virtually all requirements can be met. However, in very technical scenarios, it is suggested the client visit the technical department to discuss these issues in detail prior to any order.
User Acceptance Test - The Client will be notified when the work is complete and ready for a User Acceptance Test (to be performed by the client). A date is to be set for this test in agreement with 6gl and the client within 15 working days of the notification. If after 10 working days from the set date if 6gl has not received notification of all non conformance with the requirement in writing 6gl retains the right to deem that the site has been accepted by the client.
